These Terms and Conditions govern the use of the Estua website at estuajf and the engagement of design services provided by Estua. By accessing our website or engaging our services, you agree to these terms.
Estua is a design practice registered and operating in Malaysia, with a principal place of business at 38 Jalan Yap Kwan Seng, 50450 Kuala Lumpur.
1. Website Use
The content on this website is provided for general information purposes. While we take care to keep information accurate and current, we make no representations or warranties about the completeness, accuracy, or suitability of the content for any particular purpose.
You may browse and access the website for personal, non-commercial purposes. You may not reproduce, redistribute, or use the website's content — including text, images, and design — for commercial purposes without our prior written consent.
2. Service Engagements
Scope of work
All service engagements begin with a written scope document that outlines the deliverables, timeline, and fee. Work commences only after the scope is agreed in writing by both parties. Any changes to the agreed scope will be discussed and documented before additional work begins.
Fees and payment
Our service fees are fixed as described in the agreed scope. Fees cover design services only and do not include furniture, materials, contractor labour, or other implementation costs unless explicitly stated. Payment terms will be set out in the engagement agreement. Fees become due as specified therein.
Feedback rounds
Each service package includes a defined number of feedback rounds as stated in the scope document. Additional revision requests beyond those included will be discussed and may be subject to additional fees.
Client responsibilities
You agree to provide accurate information about your property, requirements, and relevant constraints. Timely feedback within agreed review periods supports our ability to deliver on the agreed timeline. Delays caused by late client responses may affect delivery dates.
3. Intellectual Property
All design work, drawings, visualisations, mood documents, and written specifications produced by Estua remain our intellectual property until full payment has been received. Upon receipt of full payment, you are granted a licence to use the deliverables for the purposes of your specific project.
We retain the right to use project work in our portfolio, publications, and marketing materials, subject to your privacy preferences. We will not identify your property or include identifiable personal details without your consent.
4. Confidentiality
We treat all project information as confidential. We will not share details of your project, property, or personal circumstances with third parties except where required to perform the services (such as engaging a contractor on your behalf) or as required by law.
5. Third-Party Contractors and Suppliers
Where our services involve recommending or engaging third-party contractors and suppliers, we act in your interest but we are not responsible for the performance, delays, or quality of work produced by those third parties. We will make reasonable efforts to recommend reliable parties and will communicate any issues we become aware of.
6. Limitation of Liability
To the fullest extent permitted by applicable law, Estua shall not be liable for any indirect, incidental, or consequential loss arising from your use of our website or engagement of our services. Our liability for any claim arising from a service engagement shall not exceed the fees paid for that specific engagement.
Nothing in these terms excludes liability for fraud, death or personal injury caused by our negligence, or any other liability that cannot be excluded by law.
7. Governing Law
These Terms and Conditions are governed by the laws of Malaysia. Any disputes arising from or related to these terms or our services shall be subject to the exclusive jurisdiction of the courts of Malaysia.
8. Changes to These Terms
We may update these Terms and Conditions from time to time. The updated version will be posted on this page with a revised date. Your continued use of our website or services after any changes indicates your acceptance of the revised terms.
